4. Privacy and Personal Data Protection

As a user of the Site, you are required to comply with the applicable legislation, in particular Regulation (EU) 2016/679 of 27 April 2016 on data protection (General Data Protection Regulation, “GDPR”) and French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties (the “French Data Protection Act”), any breach of which is punishable by criminal penalties.

In particular, you must refrain from any collection or misuse of the personal information to which you have access and, more generally, from any act likely to infringe the privacy, honour, sensitivities, brand image or reputation of any natural or legal person, in particular Compagnie des Alpes, by avoiding any defamatory, provocative, malicious, disparaging or threatening statement, message or text, on any medium whatsoever.

4.1 Controller and Processors

The controller of the personal data processed in connection with the Site is Compagnie des Alpes, whose contact details are given in Article 1. Butterfly acts on its behalf as a processor within the meaning of Article 28 of the GDPR: it develops, operates and maintains the Site and carries out audience measurement. The Site is hosted in France by OVH SAS.

4.2 Data Processed and Purposes

The Site has no forms, no personal area and no account creation: it does not ask you for any information about yourself. Only the following data are processed during your visit:

  • Server technical logs. Each time a page is accessed, the server records technical connection information, including your IP address, the date and time of the request and the page requested. These logs are used solely to ensure the security and proper functioning of the Site: diagnosing errors and protecting against abusive use, for example by limiting the number of requests.
  • Audience measurement. The Site measures its traffic with Matomo, under the conditions described in Article 8.3: pages viewed, date and duration of the visit, referring website, type of device and browser, approximate location derived from your IP address after it has been truncated, and a random identifier stored in a cookie.
  • Anonymous internal statistics. The Site counts plays of the home page video, clicks on the button giving access to the securities account and views or downloads of documents. For each of these, it records only the version of the Site viewed (country and language), the item concerned, and the date and time, without any IP address, cookie or identifier. These statistics cannot be used to identify you.

4.3 Legal Bases

This processing is based on the legitimate interest of Compagnie des Alpes (Article 6(1)(f) of the GDPR) in ensuring the security of its Site and measuring its traffic in order to improve it. Audience measurement cookies are exempt from consent pursuant to Article 82 of the French Data Protection Act, under the conditions laid down by the CNIL, the French data protection authority (see Article 8.3).

4.4 Recipients and Hosting

These data are processed only by Compagnie des Alpes, by Butterfly, its processor, and by OVH SAS, the host of the Site. They are not sold, rented or transferred to third parties, and are not used for advertising purposes. The Site and the audience measurement tool are hosted in France.

4.5 Retention Periods

  • Server technical logs: 30 days, then automatic deletion.
  • Raw audience measurement data: 700 days maximum, then automatic deletion.
  • Cookies: see the periods indicated in the cookie policy below (Articles 8.2 and 8.3).

4.6 Your Rights

In accordance with the GDPR and the French Data Protection Act, you may access the data concerning you, have them rectified, request their erasure or the restriction of their processing, and object to their processing on grounds relating to your particular situation. You may also set instructions concerning what happens to your data after your death. As regards audience measurement, you may object to it yourself, at any time and without having to give reasons, from the cookie management panel (see Article 8.3).

To exercise these rights, or for any question relating to the processing of your data, you may write to Compagnie des Alpes, for the attention of the Data Protection Officer, 50-52 boulevard Haussmann, 75009 Paris, France. You may also send your request by e-mail to Butterfly, its technical processor, at smoriggi@b-fly.com: your request will be forwarded to Compagnie des Alpes. To find out more about your rights, visit the CNIL website.

If, after contacting us, you consider that your rights have not been respected, you may lodge a complaint with the Commission nationale de l’informatique et des libertés (CNIL), online or by post (Service des plaintes, 3 place de Fontenoy, 75007 Paris). You may also contact the data protection authority of the country in which you reside or work:

5. Hyperlinks

Compagnie des Alpes cannot be held liable for hyperlinks to other websites, in particular with regard to the content of those websites. This is the case for the “Go to my securities account” button, which opens the Uptevia website: the information you view or enter there is the responsibility of Uptevia and is governed by its own data protection policy.

Compagnie des Alpes is not responsible for hyperlinks leading to this Site and prohibits anyone from setting up such a link without its prior written authorisation.

6. Disclaimer Regarding Forward-Looking Information

The Site may contain certain non-historical data constituting forward-looking statements, including statements regarding future events, trends, plans or objectives. These statements are based on management’s current views and assumptions and are subject to significant risks and uncertainties that could cause actual results to differ materially from those expressed or implied in these statements (or from past results). Additional information concerning these risks and uncertainties is contained in the documents filed by Compagnie des Alpes with the competent authorities. Forward-looking statements are made as of a given date and Compagnie des Alpes undertakes no obligation to update or revise them, whether as a result of new information, future events or for any other reason.

7. General Provisions

Any assignment or other transfer of the rights granted by these Terms is strictly prohibited.

If, for any reason whatsoever, a court of competent jurisdiction were to hold that any provision of these Terms is invalid, the invalidity of that provision shall in no way affect the validity of the remainder of the Terms, which shall remain in force.

The failure by either party to exercise any right or legal action under these Terms shall not be deemed a waiver of such right or action.

The Site is governed by French law. These Terms shall be governed by and construed in accordance with French law.

Cookie Policy

8.1 General

A cookie is a small file placed on your device (computer, tablet, smartphone) when you visit a website. It records information about your browsing, for example to remember a choice or to measure the website’s traffic.

The cookies described below are set by the Site on its own domain. The Site does not use any advertising cookies or social network cookies. Browsing the Site does not require any cookies.

8.2 Cookies Necessary for the Operation of the Site

These cookies are essential and exempt from consent:

  • tarteaucitron: stores your choice regarding audience measurement, for example your refusal. Lifetime: 12 months.
  • PHPSESSID: session cookie reserved for the administration area, used only by the persons responsible for updating the content of the Site. It is not set on visitors’ devices. It is deleted when the browser is closed.

8.3 Audience Measurement (Matomo)

The Site measures its traffic with Matomo, an open-source audience measurement tool installed and operated by Butterfly on servers located in France (matomostats.b-fly.com). The statistics are compiled exclusively on behalf of Compagnie des Alpes, for the sole purpose of understanding how the Site is used and improving it.

This measurement meets the conditions laid down by the CNIL for exemption from consent: it therefore starts from your first visit, without any prior consent banner. In return:

  • your IP address is truncated before anything is recorded (the last two bytes of an IPv4 address are masked);
  • the data are used solely to produce traffic statistics: they are not combined with other processing operations, transmitted to third parties or used to build an advertising profile;
  • you are not tracked on other websites;
  • raw data are kept for a maximum of 700 days, then automatically deleted.

Matomo sets the following cookies, whose names begin with “_pk_”:

  • _pk_id: random visitor identifier, used to recognise a browser returning to the Site. Lifetime: 13 months.
  • _pk_ses: links the pages viewed to a single visit. Lifetime: 30 minutes.
  • _pk_ref: stores the referring website when you arrive on the Site. Lifetime: 6 months.

You may object to this measurement at any time, without any consequence for your browsing: click on the cookie management icon displayed at the bottom left of each page, or on this link: manage audience measurement, then refuse the Matomo service. Your refusal is stored for 12 months by the tarteaucitron cookie: Matomo’s cookies are then deleted and no further browsing data are sent to Matomo. The refusal link provided at the bottom of this page opens the same panel.

To find out more, see the CNIL page on solutions for audience measurement tools.

8.4 Configuring Your Browser

You can also configure your browser to block or delete cookies, for all websites or only for some of them. The procedure depends on your browser: it is described in its online help, and the CNIL summarises it in its tips for controlling your browser.

If you block or delete the tarteaucitron cookie, the Site will no longer be able to remember any refusal of audience measurement you may have expressed: you will then need to express it again.

Audience measurement

This site measures its traffic with Matomo, a tool we host ourselves. These statistics are used only to understand how the site is used and to improve it. They remain anonymous: your IP address is truncated before anything is stored, no advertising profile is created, no data is passed on to third parties and you are not tracked across other sites. Raw data is kept for 700 days at most. You can opt out at any time, with no effect on your browsing.
